BotBall est une simulation de divertissement et un jeu de spectateur. Des agents logiciels (« bots »), des personnages animaliers fictifs et un participant humain font des prédictions hypothétiques sur des matchs de football réels en utilisant des points virtuels sans valeur monétaire, qui ne peuvent être achetés, vendus, transférés, échangés, retirés ni convertis en argent, biens ou services, et ne constituent ni propriété, ni monnaie, ni instrument financier, ni valeur mobilière, ni prix.

Le Service n’est pas not un service de jeu, pari, mise, loterie, fantasy-sport payant ou de pronostics. Nous n’acceptons aucune mise, dépôt ou paiement et ne payons aucun gain.

Aucun élément du Service – y compris le jeu « Battre les Bots », les Groupes d’Amis, le classement, le marché des titres ou la fonctionnalité « Banque BotBall » – n’implique de l’argent réel ou quelque chose ayant une valeur réelle.

Rien dans le Service ne constitue un pari, un jeu, un investissement, un conseil financier, juridique ou professionnel, ni une recommandation, sollicitation ou incitation à parier. 4. Admissibilité et âge

Le Service est destiné aux adultes. Vous devez avoir au moins 18 years of age (or the age of majority in your jurisdiction, if higher) to use it. By using the Service you represent and warrant that you meet this requirement. We do not knowingly permit minors to use the Service and will remove data relating to a minor upon becoming aware of it (see the Privacy Policy).

You are responsible for ensuring that your use of the Service complies with the laws of the place where you access it. We make no representation that the Service is appropriate or available in every jurisdiction.

5. Accounts, nicknames and sign-in

You may use most of the Service without registering. To keep predictions across visits you may either (a) choose a nickname, in which case a random token is stored in your browser and on our servers, or (b) sign in with Google, in which case we receive only your Google account identifier, first name and profile picture URL — we never receive or store your password and we do not store your e-mail address.

You are responsible for keeping your device and Google account secure and for all activity that occurs under your nickname or sign-in. Nicknames must not be offensive, misleading, impersonate any person or infringe any rights; we may change or remove any nickname at our discretion. You may delete your BotBall data at any time from within the Service (see the Privacy Policy, section 9).

6. Virtual points, the Bank and the leaderboard

All budgets, stakes, returns, loans, interest, savings, credit tiers, leaderboard positions, title-market positions and similar figures shown on the Service (“Virtual Items”) are simulated game elements. Virtual Items are licensed to you for use within the Service only, are not owned by you, have no cash value and may be adjusted, reset, corrected or removed by us at any time, including to correct errors, to repair data or when a season ends.

The “BotBall Bank” is a fictional in-game mechanic that applies to the software bots. It does not offer, and must not be understood as, banking, lending, deposit-taking or any regulated financial service to any person.

Results are graded automatically from third-party data sources and may be corrected retroactively where a source publishes a correction. We may void, re-grade or annul any fixture, gameweek or competition where data is unavailable, unreliable or manifestly wrong.

7. Acceptable use

You agree not to:

1. use the Service for any unlawful purpose or in breach of any applicable law;
2. use the Service or any content on it to operate, promote or facilitate real-money gambling;
3. scrape, crawl, harvest or systematically extract data from the Service other than through the public endpoints we expressly document, at a reasonable rate and in accordance with our robots directives;
4. attempt to gain unauthorised access to any part of the Service, its servers, accounts or data, or probe, scan or test the vulnerability of the Service;
5. interfere with or disrupt the Service, including by overloading it, introducing malicious code or circumventing rate limits;
6. impersonate any person or misrepresent your affiliation;
7. submit content that is unlawful, defamatory, hateful, harassing, obscene or infringing;
8. use automated means to make predictions or to manipulate leaderboards, groups or statistics; or
9. reverse-engineer or copy the Service except to the extent permitted by mandatory law.

We may investigate suspected breaches and take any action we consider appropriate, including removing content, suspending or terminating access and reporting to law-enforcement authorities.

8. Content, intellectual property and licence

The Service and all material we create for it — including the BotBall name and logo, bot personas and their names, nicknames, biographies and commentary, the Judge, the design, code, graphics, text, compilations and the selection and arrangement of data — are owned by us or our licensors and are protected by copyright, trademark and other intellectual-property laws. All rights not expressly granted are reserved.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial entertainment. You may share links to pages of the Service and quote short excerpts (for example a bot's pick or a leaderboard position) with attribution to bot-ball.com. Any other reproduction, redistribution, commercial use or creation of derivative works requires our prior written consent.

9. Third-party data, odds and trademarks

Fixtures, results, league tables, statistics, expected-goals data, line-ups, injury information, live match data, odds and news headlines are obtained from third-party providers and public sources under their respective terms. We do not guarantee their accuracy, completeness or timeliness and we are not responsible for errors originating from those sources.

Names of leagues, clubs, competitions, players, bookmakers and AI products (including Claude, ChatGPT, Gemini, Grok, Copilot, DeepSeek, Kimi, Manus and Base44) are the trademarks of their respective owners and are used solely for identification, description and commentary. The bots on the Service are rule-based software personas; they are not operated by, endorsed by, affiliated with or connected to those companies or products, and their picks do not represent the output of those products. BotBall is not affiliated with any league, club, governing body, data provider or bookmaker.

10. Friends Groups and user content

Friends Groups allow you to create private prediction leagues with people you know. You are responsible for anyone you invite, for the group name and settings you choose, and for any content you submit (“User Content”). You retain ownership of your User Content and grant us a worldwide, royalty-free, non-exclusive licence to host, store, display and process it as necessary to operate the Service. We may remove any User Content or group that we consider in breach of these Terms. Group codes and invite links are not secret credentials; anyone who has a link may join.

11. Availability, changes and suspension

The Service is provided on an “as available” basis. We may modify, suspend, restrict or discontinue all or part of the Service, any feature, season, competition or Virtual Item at any time without notice or liability. We do not guarantee that the Service will be uninterrupted, timely, secure or error-free, that data will be preserved, or that live scores and statistics will be current. Scheduled and unscheduled maintenance, third-party outages, data-provider limits and hosting incidents may affect availability.

12. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT OR AVAILABILITY. WE DO NOT WARRANT THAT ANY PREDICTION, STATISTIC, ODDS FIGURE, SCORE OR OTHER INFORMATION IS ACCURATE, COMPLETE OR CURRENT. PAST PERFORMANCE OF ANY BOT, PERSONA OR PARTICIPANT IS NOT AN INDICATION OF FUTURE RESULTS AND HAS NO PREDICTIVE VALUE FOR REAL-WORLD OUTCOMES.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BOTBALL, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS OR DATA PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF MONEY, PROFITS, REVENUE, DATA, GOODWILL OR OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS.

THIS INCLUDES, WITHOUT LIMITATION, ANY LOSS INCURRED THROUGH REAL-WORLD WAGERING OR OTHER DECISIONS MADE IN RELIANCE ON CONTENT FROM THE SERVICE, WHETHER THE CLAIM IS BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE OR OTHERWISE, AND EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BECAUSE THE SERVICE IS PROVIDED FREE OF CHARGE, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED EUROS (EUR 100) OR THE MINIMUM AMOUNT PERMITTED BY APPLICABLE LAW, WHICHEVER IS GREATER.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. Where a jurisdiction does not allow certain exclusions or limitations, they apply to the maximum extent permitted.

14. Indemnity

You agree to indemnify, defend and hold harmless BotBall and its owners, officers, employees, contractors and licensors from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your User Content, or your violation of any law or the rights of any third party.

15. Termination

You may stop using the Service at any time and may delete your data as described in the Privacy Policy. We may suspend or terminate your access, delete your nickname, sign-in association, predictions or groups, and remove any content, at any time and for any reason, including breach of these Terms, without notice or liability. Sections 3, 6, 8, 9 and 12 to 17 survive termination.

16. Governing law and disputes

These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or the Service, are governed by [governing law — e.g. the laws of the State of Israel], without regard to conflict-of-laws rules. Subject to any mandatory consumer-protection rules of your country of residence that cannot be excluded by agreement, the [competent courts — e.g. the courts of Tel Aviv-Yafo, Israel] have exclusive jurisdiction. If you are a consumer in the European Union, you may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged and do not undertake to participate in dispute-resolution proceedings before a consumer arbitration board.

17. General

Entire agreement. These Terms, the Privacy Policy and the Cookie Policy constitute the entire agreement between you and us regarding the Service.

Severability. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions remain in full force.

No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment. You may not assign these Terms; we may assign them to a successor or affiliate.

Langue. These Terms are drafted in English; any translation is for convenience only and the English version prevails.
